The liner is not lining up with how the photo suggests. The ties are on opposite corners unlike the photo that is showing same side ties. Am I wrong?

The ties be on the same side as the hinges. You tie around the gaps in the corners. It will overlap as a fold about two inches on the opposite side (not like four or five inches) and can shift depending on the weight of your clothes. The side hooks with the small bag can help keep it in place a bit.

Is the bottom of the hamper strong enough to use the hamper without the bags? I am not a fan of bags.
