Q: Are these waterproof that can be used in the shower?

The headband portion is fine but if the ear cushions get wet, the noiseoff may not work properly. I would not recommend it to use under water since the ear cushions are not waterproof.

Q: Will these fit my 3yr old?

No, not at all. I purchased them for my 9 year old, and though small for his age, they didn't fit him. They're also cheaply made and I feel they do not cancel enough noise.
